II - General Terms and Conditions of Contract for Guided Tours by Commercially Authorised Tourist Guides for Agencies and Business Partners
The contract concerning the organisation of a guided tour or additional services is concluded under the following conditions:
1. Contractual terms and conditions - These contractual terms and conditions shall become valid if this has been agreed in detail between the contracting parties.
2. Remuneration - If no separate or deviating regulation has been agreed, a customary local tour at a customary local fee shall be deemed to have been agreed. In Vienna or for Viennese tourist guides, the customary local fee is deemed to be the fee usually charged by Viennese tourist guides, which is published annually by the Association of Certified Viennese Tourist Guides in the course of its survey of its members.
3. Invoicing - The client is requested to invoice his customer separately for the contract fee for the guide's services (guide's fee) and any booking fee for arranging the guide's extra services.
4. Tour escort activities of a tourist guide (§ 126 para 4 GewO), in particular transfers, are to be treated as guided tours.
5. Waiting times - If the customer is late, the guide is obliged to wait 15 minutes for the customer at the agreed meeting point. The customer in turn undertakes to wait 15 minutes for the guide. The waiting time is included in the duration of the tour.
6. Cancellation policy - The client does not have to pay the guide a cancellation fee if the cancellation is made in writing at least 14 days (received by the guide) before the tour date. If the client cancels between 14 and 3 days before the agreed tour date, 50% of the agreed tour fee must be paid as a cancellation fee. If the client cancels less than 3 days before the agreed tour date, the full agreed fee (100%) must be paid. The day of cancellation and the agreed tour date are included in the calculation of the deadline. The cancellation fees stated here are flat-rate penalties that must be paid regardless of fault or damage incurred. The cancellation fee must be paid separately for each individual cancelled tour.
7. Prevention/illness - In the event of unavoidable prevention, the tour guide undertakes to provide a professionally equivalent and authorised replacement. The client must be informed of this immediately. This applies to standard guided tours, but not to our own special themed tours. In this case, the tour must unfortunately be cancelled without replacement or can be postponed to another time.
8. Payment - Payment shall be made in cash after performance of the service or by bank transfer immediately after invoicing without deduction. Any bank charges incurred shall be charged to the client. Interest on arrears shall amount to 1% per month (12% p.a.)
9. Individual guided tours - programmes for individual guided tours are charged separately. Entrance fees, transport services etc. are also invoiced separately, usually with a flat-rate surcharge of 10% on all cash expenses.
10. Disclaimer - Participation in guided tours is at your own risk. Guides are only liable for damages that they have unlawfully and culpably caused to their guests, but under no circumstances are they liable if the guest comes to harm through their own behaviour or by accident. No liability is accepted for changes to guided tours or tours due to unforeseen and uncontrollable events and no discount is granted.
